The instruments that govern employment of staff in long day care are the Fair Work Act 2009 incorporating the National Employment Standards (NES), the Children's Services Award 2010 and the Educational Services (Teachers') Award 2010. The Awards came into effect on 1 January 2010.

Please ensure that you have a thorough knowledge of these instruments. In addition, please ensure that you have a copy of the NES and the Awards available for your staff to access as there are very heavy fines for failing to do so.

To enable you to quickly and accurately determine your employees' wage rates, ACAV provides a wage table for each of the awards (see link below). These wage tables are updated as and when required. The wage tables were last updated to reflect the FWC decision on 31 May 2016.

National Employment Standards

From 1 January 2010, employers and employees in the national workplace system are covered by the National Employment Standards (NES).

Under the NES, employees have certain minimum conditions. Together with pay rates in modern awards (which also generally take effect from 1 January 2010) and minimum wage orders, the NES makes up the safety net that cannot be altered to the disadvantage of the employee.

The NES include minimum entitlements to leave, public holidays, notice of termination and redundancy pay.

Fair Work Information Statement

From 1 January 2010, this Fair Work Information Statement is to be provided to all new employees by their employer as soon as possible after the commencement of employment. The Statement provides basic information on matters that will affect employment.
